Spouses of Open Work Permit holders are now eligible to apply for Open Work Permits

Sean Fraser made the historic declaration that Canada will work to keep families of people with Open Work Permits together.

On December 2, 2022, Immigration, Refugees and Citizenship Canada (IRCC) made the announcement that spouses of OWP holders would now be eligible for Open Work Permits (OWP). This was made by Minister of Immigration Sean Fraser.

Before this change, a spouse could only get a work visa if the main applicant was employed in a high-skill job. By keeping families together, this interim approach hopes to enhance the employees' physical health, mental stability, and financial security. It is anticipated that as a consequence, the employee would fit in with their community and workplace better.

Canada will gradually extend the ability to work in the country to wives and children who are of working age beginning in January 2023 through a temporary 2-year measure for all skill levels of employees. Families of employees in the healthcare, trades, and hospitality industries, among others, would fall under this category. Additional than 200,000 foreign workers' families are predicted to start working in Canada as a result of this new strategy, providing more opportunities for both foreign employees looking to work there and companies trying to fill their labor shortages.

What are Open Work Permits?

Foreign nationals who are neither Canadian citizens nor permanent residents are able to work here with the use of work permits. Work permits are frequently provided for a particular work with a certain business. However, OWPs give foreign people the freedom to work lawfully in Canada for any firm and in any position.

New changes to OWP eligibility

The opening up of eligibility to OWP spouses is a significant step toward luring more immigrants to work in Canada and perhaps ultimately reside there. The possibility for wives of foreign students, Canadian permanent residents, and citizens to be sponsored by their spouses for an OWP was always available, but the eligibility increase for spouses of current OWP holders demonstrates Canada's openness to welcoming additional immigrants.

As a result of this policy change, IRCC anticipates receiving more than 100,000 new work permit applications from spouses of OWP holders.

At the beginning of 2023, the program is anticipated to be implemented in three stages:

High-wage stream—For spouses of higher-paid workers who hold an open work permit (eg: spouses of Post Graduate Work Permit holders).;

Provinces and territories stream—For spouses of lower-wage workers (e.g.: OWP holders under the International Experience Canada program, which recently saw an increase in program size); and

Families of agriculture workers—This phase would specifically deal with families of seasonal agriculture workers, a key stream of employment that Canada is trying to expand as part of its economic recovery.

Ten years ago there were nearly seven Canadian employees for every retiree exiting the employment, Minister Fraser highlighted in his announcement on December 2. In the next 10 to 15 years, this ratio is anticipated to drop to two from its present level of closer to three employees for every retiree. If these figures do not increase, Canada will not have the skilled labor it needs to maintain its most important industries, such as healthcare and education, much alone its economic expansion or general well-being.

For Canada's society to remain healthy, policy changes like the one mentioned above will be essential. By the end of 2025, the IRCC has already committed to accepting nearly 1.45 million new immigrants (under the Immigration Levels Plan 2023–2025).
